The ruling was presided over by Judge Joanne Dunlop during a hearing at the Manchester Employment Tribunal, who said she had concluded that Mendy is entitled to recover some, but not all of the sums claimed.

She said,

"While Mr Mendy was not in custody, he was ready and willing to work and was prevented from doing so which was unavoidable or involuntary on his part. In those circumstances, and absent any authorisation in the contract for the employer to withhold pay, he was entitled to be paid. I doubt that quite so much legal expertise and endeavour has ever before been expended in the prosecution and defence of a wages claim brought by a single claimant.But then, I am also fairly sure that no other single claimant has ever alleged that sums in the region of £11 million have been deducted from his wages.”

What happened between Benjamin Mendy and Manchester City?

The French international took Manchester City to an employment tribunal in Manchester last month ( October 2024) claiming his former club had wrongly stopped his £500,000-a-month salary after he was charged with sex offences and remanded into custody in August 2021.

The 30-year-old claimed a 22-month period, five of which were when he was in custody for breaching bail conditions and therefore not entitled to pay.

Recall that Mendy was found not guilty of six counts of rape and one count of sexual assault in January 2023, but the same jury could not reach a verdict on another count of rape and one count of attempted rape. This led to a retrial after which the French man was found not guilty of one charge of rape and one charge of attempted rape.

However, with this current ruling, this means that the exact amount he will receive is to be calculated by Mendy and the club, or determined at a future hearing if they cannot reach an agreement.

The French international has decided to sue last season's treble winners for multi-millions of pounds after they refused to pay him his wages. The 29-year-old filed a claim with the employment tribunal in the last few days claiming an unauthorised deduction after he was charged with rape and sexual assault in 2021.

Benjamin Mendy was found not guilty on all counts early this year (2023) and he is seeking the monies that Manchester City owes him until the end of his contract in June 2023.

Sky Sports News confirmed in a statement that Nick De Marco KC (instructed by Laffer Abogados (Madrid) is acting for the former Manchester City player Benjamin Mendy in a multi-million-pound claim for unauthorised deductions from wages. Manchester City FC failed to pay Mr Mendy any wages at all from September 2021, following Mr Mendy being charged with various offences all of which he was subsequently acquitted of, until the end of his contract in June 2023. The claim will come before an Employment Tribunal.

Mendy joined City from Monaco for £52 million in 2017 which was the highest amount paid for a defender at that time in the Premier League. He won three titles with the Manchester club and was also part of France's World Cup-winning squad in 2018.

The defender was not welcomed by some supporters of his new club, Lorient as they referred to him as a rapist. A sports agency in France Le Télégramme confirmed that the banners were displayed on Lorient’s Grand Théâtre steps near Les Merlus‘ Stade du Moustoir which was translated as “What is the justice system doing? B. Mendy, A. Hakimi, W. Ben Yedder. No forgetting. No forgiveness“.

Mendy was cleared of all charges of sexual crimes last month by the Chester Crown Court. He completed his move to the Ligue 1 a few days after the verdict by signing a two-year contract with FC Lorient.

Meanwhile, Hakimi has been accused of rape by a 24-year-old woman last February. The Moroccan international was charged several days later with an investigation underway. Ben Yedder, has also been charged with rape, attempted rape, and sexual assault.

Benjamin Mendy's contract recently expired with Manchester City in June 2023 where he made a total of 75 appearances for the club, winning four Premier League titles during his time with the Cityzens. He was also a member of the France squad that won the 2018 World Cup.

The verdict was announced by the Chester Crown Court on Friday, January 13th, 2023 after five months since the case made its first appearance in court. The jury did not reach a verdict on a further rape charge and a separate charge of attempted rape, meaning he will return to the same court on June 26th, 2023.

Mendy was on trial along with co-accused, Louis Saha Matturie, and between them the pair had been accused by 13 women of sexual offences. Both men have denied all the offenses.

However, the jury were not able to reach an agreement on a count of rape and attempted rape. This means that the prosecutor has seven days to take a decision on the situation.

The incidents happened at Mendy's mansion between October 2018 and August 2021.

Manchester City's head coach Pep Guardiola had taken the stand via video call to testify at the rape trial involving his former player Benjamin Mendy.

According to BBC, Pep had stated that the former City player was a good boy, but he did not know him on a personal level. He went on to add that he had no idea what Mendy did in his spare time and on social media, stating that he was only interested in the French international as a player.

Pep stated that Mendy is:

an exceptional player whose heart was always happier in the locker room than out on the pitch.

When asked about the rape allegations involving the player, Pep also explained that he had been called by Mendy to give a testimony at the trial. He revealed:

"He asked me to come to be here with all of you and that's why I'm here."

The BBC revealed:

It has been alleged that Mr Mendy and his friend Louis Saha Matturie raped a number of women at the footballer's mansion or at an apartment in Manchester.

Mr Mendy has denied all the charges against him, while Mr Matturie, 41, of Eccles, Salford, has denied six counts of rape and three counts of sexual assault relating to seven young women.

Both men have said if any sex took place it was consensual.

Mendy pleaded not guilty to all the remainaing seven charges which have taken place on five occasions at the player's mansion in Cheshire between October 2018 and August 2021, the accusations are relating to seven women in total.

Mendy is also facing a new allegation for attempted rape after he appeared at the Chester Crown Court today. Mirror Football confirmed the news on its website on ( Wednesday, February 2nd, 2022), the judge ruled that the new charge for the defender can now be reported.

Mendy is now been accused of nine offences about six women. The judge set a pre-trial for March 11th, 2022. He is yet to enter a plea to all of these charges.

The Judge also urged the lawyers to ensure that the case is not delayed as the trial is expected to last for at least six weeks.

Manchester City suspended the player since the incident was reported by the Greater Manchester Police in September 2021. Sky Sports confirmed the news on its website on Tuesday, November 16th, 2021. Mendy was earlier on a four-count charge in August 2021, which led to his suspension at the Manchester club pending when the case is over.

The Police released a statement on Tuesday, November 16th, 2021 stating that Mendy has the right to a free trial.

Cheshire Constabulary and the Crown Prosecution Service would like to remind everyone that criminal proceedings against Mattuire and Mendy are live and that have a right to a fair trial.

The French defender is also charged with a single count of sexual assault. All the alleged offenses which relate to the four women are over the age of 16 and have been said to have taken place between October 2020 and August 2021.

Mendy is expected to appear at Stockport Magistrates' Court on Wednesday, November 16th, 2021. The player was initially charged on August 26th, 2021, with three counts of rape relating to an alleged incident in October 2020.
